These Terms and Conditions (“Terms”) govern your use of the Dynamic Property Group website at www.Dynamicpropertygroup.com, the homeowner portal, and any online tools we provide (together, the “Site”). “Dynamic Property Group,” “we,” “us” and “our” refer to Dynamic Property Group LLC. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Dynamic Property Group provides management services to homeowner associations and other common-interest communities. The Site gives general information about our company and lets homeowners, board members and prospective clients communicate with us.
Our management services are governed by a separate written management agreement between us and each association. Nothing on the Site creates a management contract, and using the Site does not make you our client. We act as the agent of each association’s board. Decisions about rules, assessments, fines, architectural approvals and enforcement are made by the association’s board under its governing documents.
You must be at least 18 years old to use the Site, create an account or make a payment.

You are responsible for activity that takes place under your account. The portal may be operated by a third-party software provider, and that provider’s own terms may also apply.
You may be able to pay assessments and other association charges through the Site. When you do:
You may use the Site to submit maintenance requests, architectural applications, violation reports and other forms. Submitting a request does not mean it has been approved or that work will be performed. Requests are handled according to your association’s governing documents, its board’s decisions and our management agreement.
The Site is not monitored around the clock. For a life-threatening emergency, call 911. For urgent property emergencies, call our emergency line at [phone number].
Content on the Site is general information only. It is not legal, financial, tax, insurance or real estate advice. Your association’s governing documents and applicable law always control. Please consult a qualified professional about your own situation.
We work to keep documents and account information on the Site accurate and current, but the association’s official records control if there is any difference. Requests for resale, escrow or lender documents may carry fees, as permitted by law and disclosed at the time of the request.

The Site and its content, including text, graphics, logos and design, belong to Dynamic Property Group or its licensors and are protected by copyright and trademark law. You may view and print content for your personal, non-commercial use. Any other use requires our written permission.
When you submit content to us, such as messages, photos or forms, you give us permission to use it as needed to respond to you and to manage your association.
By using the Site or giving us your email address, you agree that we may send you notices and other communications electronically, where the law allows. Some association notices must be delivered in a specific way under state law, and your delivery preferences for those notices are handled separately. Text messages are governed by our SMS Terms and Conditions.
The Site may link to websites or services operated by others, such as payment processors, portal providers and vendors. We do not control them and are not responsible for their content, security or practices.

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or secure.
To the fullest extent the law allows, Dynamic Property Group and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). This section does not change our obligations under any management agreement.
You agree to defend and hold harmless Dynamic Property Group and its owners, employees and agents from claims, losses and expenses, including reasonable attorneys’ fees, that arise from your misuse of the Site or your violation of these Terms.
We may suspend or end your access to the Site at any time if you violate these Terms or if we need to protect the Site or its users. Ending your access to the Site does not change any amounts you owe your association.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try to resolve the matter informally for at least 30 days. Any legal action relating to these Terms or the Site must be brought in the state or federal courts located in Orange County, California.
We may update these Terms from time to time. We will post the revised version on this page with a new effective date. Your continued use of the Site after a change means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy and SMS Terms, are the entire agreement between you and us regarding the Site.
